Cantey Hanger Victory upheld by Texas Supreme Court

On Friday, January 15, 2016, the Texas Supreme Court denied a motion for rehearing in Insurance Alliance v. Lake Texoma Highport, LLC and Bowood Partners, Ltd., 452 S.W. 3d 57 (Tex. App.—Dallas 2014, pet. denied). The decision upholds a trial court victory by Cantey Hanger on behalf of London based insurance broker, Bowood Partners Ltd. At trial, Lake Texoma Highport sought damages in excess of $20 million against Bowood for negligence, DTPA violations, Insurance Code violations, and fraud in connection with an insurance coverage dispute following a 2007 catastrophic flood at the Highport Marina on Lake Texoma. After a three week trial, the trial court entered a take nothing judgment on behalf of Bowood and entered judgment against Bowood’s co-defendant, Insurance Alliance. Both Highport and Insurance Alliance appealed the trial court’s decision in favor of Bowood. The Dallas Court of Appeals upheld the trial court decision in a November 2014 opinion. The Supreme Court decision effectively finalizes the victory for Bowood. Bowood was represented at trial and on appeal by Ashley Parrish, James Phillips and Steve Tatum.
