“TEXAS CONDEMNATION GETS CLEAR”, Texas Supreme Court long awaited opinion in Cause No. 13-0053, State v. Clear Channel Outdoor, Inc., April 24, 2015. The Court held that a billboard was a fixture to be valued as a part of the land, not as a separate structure, and that the loss of associated business income was not compensable.

By: Mary Colchin Johndroe*              On May 27, 2016, the Texas Supreme Court issued a seminal case in Texas condemnation jurisprudence.  In the case of In re Lazy W District No. 1, the governmental landowner filed a plea to the jurisdiction before a scheduled commissioners’ hearing, asserting immunity and requesting that commissioners’ appointments be vacated.
